FOIA vs Court Records in Wayne County
Michigan FOIA applies to "public bodies." Wayne County departments such as the Sheriff, Prosecutor, Register of Deeds, and other administrative offices process FOIA requests for their non-court records. Trial court files sit under Michigan Court Rules and the State Court Administrative Office's Trial Court Records Management Standards. The FOIA short-title statute says state public policy entitles all persons, except those in correctional custody, to full and complete information about government affairs.
For a Wayne County felony or civil circuit file, FOIA is not the right tool. The Wayne County Clerk Records Division handles those copy orders. For Sheriff inmate records beyond the public portal, the Sheriff page notes that further information may be requested via FOIA. For Register of Deeds land records, the Register of Deeds publishes its own search and copy schedule.
The statute sets the right to inspect, copy, or receive public records, the practical entry point for Wayne County FOIA requests.
Wayne County Clerk Public Records
The Wayne County Clerk Records Division covers civil court records, divorce records (1942 to present), criminal records (1942-1983 outside Detroit), name changes after 1996, and other Clerk-maintained records. The Records Division is at Coleman A. Young Municipal Center, Room LL-61, 2 Woodward Avenue, Detroit, MI 48226. Phone (313) 224-5530. Email wcrecordroom@waynecountymi.gov. Files from 2010 to present are viewable in person at the records room. Older files come from Archives; orders before 4:30 p.m. are available the next business day after 2 p.m. and held for 5 calendar days.
Register of Deeds Land Records
Register of Deeds land records cover deeds, mortgages, liens, and related real estate documents. The Register of Deeds search page lists online land records back to January 1, 1960. Free public search is name-only. On-demand paid accounts expand search by address, legal description, parcel/tax ID, and Liber and Page. The office sits at 400 Monroe, 7th Floor, Detroit, MI 48226. For deeper detail, see the Wayne County Register of Deeds page.
Sheriff and Jail Public Records
Wayne County Sheriff public records include inmate inquiry data, incident reports, FOIA-eligible administrative records, and use-of-force or policy material released under FOIA. The Sheriff says detailed inmate information beyond the portal must be requested via FOIA, with exemptions under MCL 15.243 applied where they fit. Active investigations and certain informant or security information may be withheld.
Probate Court Public Records
Probate Court files include decedent estates, guardianships, conservatorships, trust filings, wills filed for safekeeping, and probate civil actions. Many filings are public, but adoption, mental health, and certain guardianship medical detail are restricted. See the Wayne County Probate Court records page for fees, contact emails, and emergency-filing rules.
Marriage Public Records
Wayne County Clerk maintains marriage records. Certified copies cost $24.00 for the first copy and $7.00 for each additional copy at the same time. An uncertified marriage license search costs $11.50 whether the record is found or not. See the marriage and divorce records page for the full workflow.
Restricted Public Records
Not every public-body record is releasable. MCL 15.243 lists FOIA exemptions, including privacy, law-enforcement investigatory records under certain conditions, privileged material, security information, and records exempt under other statutes. Juvenile, adoption, mental health, and sealed records have additional state-law protections. Set-aside records under MCL 780.621 and related sections are nonpublic for ordinary use.
Wayne County FOIA Fee Categories
MCL 15.234 sets the FOIA fee structure. Public bodies may charge for labor, copies, mailing, and other permitted costs under the statute's framework. Wayne County departments publish their own fee notices. For courts, the Clerk Records Division and Probate Court publish separate copy and certification fees that govern those records.

How to File a Wayne County FOIA Request
FOIA requests must be in writing. Submit by mail, email, or sometimes online portal depending on the department. MCL 15.235 sets timing, denial, and appeal rules. The public body must respond within five business days, with a possible 10-business-day extension. Denials must explain the reason and identify the exemption. The requester can appeal a denial through the department's administrative review or by filing in circuit court.
- Identify the Wayne County department that holds the record.
- Write a FOIA request that describes the record clearly.
- Submit the request by mail or email to the department's FOIA coordinator.
- Wait up to 5 business days for an initial response, with a possible 10-business-day extension.
- If denied, request administrative review or file in circuit court.
- Pay any allowed fees under MCL 15.234 before document release.
Response Timing and Denials
Wayne County departments must respond within statutory windows. A response can grant the request, deny it, or partially grant and partially deny. Denials must identify the exemption. Requesters may appeal a denial to the head of the public body within 180 days. After exhausting administrative options, civil action in circuit court is the next step under MCL 15.235.
Wayne County FOIA Request Form Fields
Most Wayne County FOIA coordinators accept a simple letter or email. A standard request includes the requester's contact information, a clear description of the records, the date range, and any fee preferences. The list below covers the typical fields that keep a request from getting bounced back as too vague.
- Requester information — name, mailing address, phone, and email so the coordinator can reply.
- Date or date range — narrow the search to a specific window when possible.
- Records description — describe the record clearly enough that staff can find it without further questions.
- Subject or case identifier — case number, incident number, badge number, parcel ID, or other anchor.
- Format preference — paper copies, electronic copies, or in-person inspection.
- Fee tolerance — a stated maximum so staff can stop and confirm if costs exceed that amount.
- Indigent waiver request — for the first $20 of costs, when eligible under MCL 15.234.
Appeals After a FOIA Denial
Under MCL 15.235, a denial must explain the exemption that applies and identify the agency head who reviews appeals. The requester has 180 days to submit an administrative appeal in writing to the head of the public body. The agency must respond within 10 business days, with a possible 10-day extension. After the administrative appeal, the requester may file a civil action in circuit court. The court may order disclosure, award fees, and impose punitive damages for willful violations.
FOIA appeals are separate from court record motions. If the denial relates to a court file, file a motion in the originating court rather than an administrative appeal. Wayne County court files run under court rules rather than under the FOIA framework.
Other Wayne County Public Records
Beyond courts and law enforcement, Wayne County public records include business assumed names, co-partnership certificates, notary public appointments, and military discharge records kept by the Wayne County Clerk. The Clerk also acts as Secretary to the Board of Election Commissioners and clerk of the Board of County Canvassers. Election-related public records, including campaign finance and election results documentation, run through the Clerk's elections operation. For Concealed Pistol License records, the Clerk publishes a separate CPL line at (313) 224-5565 and email cpl@waynecountymi.gov.
